1. Acceptance of Terms
By accessing, browsing, or using the LianHomes website ("lianhomes.co.ke"), mobile applications, booking services, and any other services offered by LianHomes (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and LianHomes, a vacation rental management company operating in Syokimau, Nairobi, Kenya.
2. Definitions
- "LianHomes," "we," "us," or "our" refers to LianHomes, the owner and operator of the website and services.
- "Guest," "you," or "your" refers to any individual or entity using our Services or booking accommodation.
- "Property" refers to any apartment, residence, or accommodation listed on our platform, including Artesano, InDesign Makumbi, Apple Tree, and Mango Tree.
- "Booking" refers to a confirmed reservation of a Property for a specified period.
- "Host" refers to the property owner or manager responsible for the accommodation.
3. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Provide accurate, current, and complete information during the booking process
- Not be prohibited from using our Services under applicable Kenyan law
4. Booking and Reservations
4.1 How to Book

4.2 Booking Confirmation
A booking is only confirmed upon:
- Receipt of full payment or agreed deposit
- Issuance of a booking confirmation email or message
- Agreement to these Terms and our Cancellation Policy
4.3 Payment Terms
- Full payment is required at the time of booking unless otherwise agreed
- We accept M-Pesa, bank transfer, and card payments
- All prices are quoted in Kenyan Shillings (KES) unless otherwise stated
- Prices include applicable taxes unless stated otherwise
5. Check-in and Check-out
- Standard Check-in: 3:00 PM
- Standard Check-out: 11:00 AM
- Early check-in and late check-out may be available upon request, subject to availability and additional charges
- Guests must provide a valid government-issued ID at check-in
- Access codes for smart locks are sent 24 hours before check-in via SMS and email
6. House Rules
By booking with LianHomes, you agree to the following house rules:
- No smoking inside the properties (designated outdoor areas may be available)
- No parties or events without prior written approval
- Quiet hours: 10:00 PM to 7:00 AM
- Maximum occupancy must not exceed the stated limit for each property
- Pets are only allowed in designated pet-friendly properties with prior approval
- No illegal activities on the premises
- Treat the property and neighbors with respect
- Report any damages or maintenance issues immediately
Violation of house rules may result in immediate termination of your stay without refund, and you may be held liable for any damages caused.
7. Damages and Liability
7.1 Security Deposit
A refundable security deposit may be required for certain bookings. This deposit will be refunded within 7 business days after check-out, provided there are no damages or violations.
7.2 Damage Policy
- Guests are responsible for any damage caused to the property, furnishings, or appliances during their stay
- Accidental damage should be reported immediately
- The cost of repairs or replacement will be deducted from the security deposit or charged to the guest
- Willful damage or theft may result in criminal prosecution under Kenyan law
7.3 Limitation of Liability
LianHomes' liability is limited to the amount paid for the booking. We are not liable for:
- Personal injury or loss of life, except where caused by our negligence
- Loss or damage to personal belongings
- Force majeure events (natural disasters, power outages, government actions)
- Third-party services (restaurants, tours, transportation)
8. Intellectual Property
All content on the LianHomes website, including but not limited to text, images, logos, designs, and software, is the property of LianHomes or its licensors and is protected by Kenyan and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, or distribute our content without written permission
- Use our trademarks or logos without authorization
- Scrape, data-mine, or systematically collect information from our website
- Reverse-engineer any part of our website or services
9. User Conduct
When using our Services, you agree not to:
- Provide false or misleading information
- Impersonate any person or entity
- Use our Services for fraudulent purposes
- Interfere with the proper functioning of our website
- Upload viruses, malware, or harmful code
- Harass, abuse, or harm other users or our staff
10. Third-Party Services
Our website may integrate with third-party services including:
- Google Maps (location services)
- WhatsApp (communication)
- IntaSend / M-Pesa (payments)
- EmailJS (form processing)
- Social media platforms
Your use of these services is subject to their respective terms and privacy policies.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall be resolved through:
- Good faith negotiation between the parties
- Mediation through a mutually agreed mediator
- Arbitration under the Arbitration Act, 1995 (Kenya) if mediation fails
- The courts of Kenya as a last resort
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
